The Perishable Agricultural Commodities Act ("PACA") is a Federal act which regulates the sale of fresh and frozen fruits and vegetables. Growing out of his general representation of companies in this industry over more than 20 years, Mr. Wood has become one of a handful of attorneys in the region knowledgeable about the developing case law based upon the PACA. As a result, the Law Office of Ralph Wood both prosecutes and defends claims under the trust provisions of the PACA, including the pursuit of the recovery of PACA trust funds in Bankruptcy Court. The PACA trust provisions provide a powerful tool to produce vendors, who comply with its terms, for the collection of receivables. In many cases funds can be recovered from the bankrupt estate of the customer or from other creditors of the customer, including secured creditors. The PACA also provides for the licensing of produce dealers by the U.S. Department of Agriculture and strict rules with which licensee's must comply. Mr. Wood is experienced in counseling licensees with regard to their obligations under the act and with regard to disciplinary action brought by the Department of Agriculture.
